These Terms of Service ("Terms") govern your access to and use of the Fytness mobile application, web application, and related services (collectively, the "Service").
By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Provider

The company is the legal service provider and data controller unless stated otherwise.
2. Eligibility
- You must be at least 16 years old to use the Service.
- By using the Service, you confirm that you have the legal capacity to enter into a binding agreement.
3. Account Registration
- An account is required to use the Service.
- You must provide accurate and complete information during registration.
- You are responsible for maintaining the confidentiality of your login credentials.
- You are responsible for all activity that occurs under your account.
Supported login methods:
- Email and password
- Google sign‑in
4. Account Deletion
You may delete your account at any time directly in the app settings. Upon deletion:
- Your access to the Service will terminate
- Your data will be handled according to the Privacy Policy
5. Use of the Service
You agree to use the Service only for lawful purposes and in accordance with these Terms.
You must not:
- Use the Service for illegal activities
- Attempt to gain unauthorized access to systems or data
- Reverse engineer, copy, or resell the Service
- Abuse, overload, or interfere with the Service
6. User Content
6.1 Allowed Content
You may input, create, and store:
- Workout logs
- Meal logs
- Custom sport activities or exercises created by you
- Custom meals created by you
6.2 Ownership
- You retain ownership of your content.
- You grant Fytness a non‑exclusive, worldwide, royalty‑free license to store, process, and display your content solely to operate the Service.
6.3 Responsibility
You are solely responsible for the accuracy and legality of the content you provide.
7. Health & Fitness Disclaimer
The Service is provided for informational purposes only.
- Fytness does not provide medical advice.
- The Service is not a substitute for professional medical, nutritional, or fitness advice.
- Always consult a qualified physician or health professional before starting any fitness or nutrition program.
- Use of the Service is at your own risk.
8. Subscriptions & Payments
- The Service is currently provided free of charge.
- Fytness reserves the right to introduce paid features or subscriptions in the future.
- Payments may be processed via Stripe, Apple App Store, or Google Play, subject to their respective terms.
- Any future paid features will be clearly disclosed before purchase.
9. Intellectual Property
All rights, title, and interest in the Service, including software, branding, and design, are owned by Fytness or its licensors.
You may not copy, modify, distribute, or create derivative works without prior written consent.
10. Availability & Changes
- The Service is provided on an "as is" and "as available" basis.
- Fytness does not guarantee uninterrupted or error‑free operation.
- Fytness may modify or discontinue parts of the Service at any time.
11. Suspension & Termination
Fytness reserves the right to suspend or terminate your account if you:
- Violate these Terms
- Misuse the Service
- Engage in unlawful behavior
Termination may occur without prior notice where legally permitted.
12. Limitation of Liability
To the maximum extent permitted by law:
- Fytness shall not be liable for indirect, incidental, or consequential damages
- Fytness shall not be liable for data loss, health outcomes, or service interruptions
13. Indemnification
You agree to indemnify and hold harmless Fytness from claims, damages, or expenses arising from your misuse of the Service or violation of these Terms.
14. Governing Law & Jurisdiction
- These Terms are governed by the laws of the Slovak Republic and applicable European Union law.
- For users outside the EU (including the United States), mandatory local consumer protection laws may also apply.
- Any disputes shall be resolved by competent courts of the Slovak Republic, unless otherwise required by law.
15. Changes to Terms
Fytness may update these Terms from time to time.
- Changes will be communicated via the Service or website
- Continued use of the Service constitutes acceptance of the updated Terms
